KAYAK RENTAL LIABILITY WAIVER AND RELEASE AGREEMENT

THIS IS A LEGAL DOCUMENT. READ CAREFULLY BEFORE SIGNING.

This Kayak Rental Liability Waiver and Release Agreement (the “Agreement”) is made and entered into on this by and between:

Hereinafter referred to as “Participant” and Karl Young, hereinafter referred to as “Owner.”

1. ASSUMPTION OF RISK

I, the undersigned Participant, acknowledge that kayaking involves inherent risks, including but not limited to:

Drowning
Collisions with other vessels or objects
Capsizing
Hypothermia
Injuries caused by wildlife
Changing water and weather conditions
Equipment failure

I voluntarily assume full responsibility for any risks of loss, property damage, personal injury, or death related to the rental and use of the kayak, regardless of cause.

2. RELEASE OF LIABILITY AND WAIVER

I, on behalf of myself, my heirs, executors, and assigns, hereby release, discharge, and hold harmless Karl Young, its owners, employees, agents, and affiliates (collectively, the “Released Parties”) from any and all claims, liabilities, damages, injuries, losses, or demands that may arise out of or in connection with my participation in kayaking activities, including but not limited to negligence by the Released Parties.

3. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from and against any claims, lawsuits, damages, costs, or expenses, including attorneys’ fees, arising from my participation in kayaking activities.

4. SAFETY & EQUIPMENT

I acknowledge that I have a life jacket (PFD) and that I will wear it at all times while on the water.
I confirm that I am familiar with proper kayaking techniques and safety procedures.
I agree not to operate the kayak under the influence of alcohol, drugs, or any impairing substances.
I understand that I am responsible for returning all rented equipment in the same condition as received.

5. MEDICAL CERTIFICATION

I certify that I am physically fit to participate in kayaking and have no medical conditions that would prevent my safe participation.

6. DAMAGE & LOSS RESPONSIBILITY

I agree to return all rental equipment in its original condition. I understand that I am financially responsible for any damages, loss, or theft of the kayak, paddle, PFD, or any other rented equipment.

7. GOVERNING LAW & SEVERABILITY

This Agreement shall be governed by the laws of the State of Utah. If any part of this Agreement is found to be legally unenforceable, the remaining provisions shall remain in full force and effect.

8. ACKNOWLEDGEMENT AND SIGNATURE

I (Participant’s Full Name) acknowledge that I have read this Agreement, understand its terms, and voluntarily agree to be bound by its conditions. I understand that I am waiving legal rights, including my right to sue.

9. PARENT/GUARDIAN ACKNOWLEDGEMENT (FOR MINORS UNDER 18)

If signing on behalf of a minor (under 18 years of age), I certify that I am the minor’s parent or legal guardian and that I have the legal authority to sign this Agreement on their behalf. I acknowledge that the minor is bound by all terms of this waiver, and I assume full responsibility for their safety and actions while participating in the rental activity.
